Shipping and Delivery

Shipping costs are always charged at cost, unless otherwise agreed in writing. We accept no liability for any delays in delivery caused by the shipping company or other circumstances beyond our control. Unless otherwise agreed, DAP Incoterms® 2020 applies to deliveries within Sweden.

For deliveries outside Sweden, the terms of delivery specified in the quote or in a separate agreement apply.

For pallet deliveries, a pallet fee of 100 SEK applies for a full pallet and 60 SEK for a half pallet. 

Ordering and Right of Withdrawal
Once an order is placed, it is binding.
Please make sure all information is correct before completing your order. 

No right of withdrawal applies (B2B). A contract is considered concluded once you have received an order confirmation. 

If incorrect pricing information is provided prior to order confirmation, we are not bound by the stated price. 

Complaints and Customer Service

If you have any questions or wish to file a complaint, please contact us atordering@amabiliamedical.com within 30 days of discovering the defect in the product. We strive to handle all complaints quickly and efficiently to minimize any disruption to your business. When submitting a complaint, please provide the order number, invoice number, and customer number. You must be able to demonstrate the defect or damage, for example, with a photo.

Our customer service is open from 8:30 a.m. to 5:00 p.m. on all weekdays (excluding holidays). 

Use of the customer's trademarks

In the event that we need to use the customer’s trademarks, the customer grants us the right to use the customer’s name and logo for marketing purposes, including but not limited to websites, social media, and presentations, as a reference during the term of the agreement. The customer may revoke this consent in writing at any time. 

Price and Payment

All prices are listed exclusive of value-added tax (VAT). 

Standard payment terms are 14 days from the invoice date, subject to approval of a credit assessment, unless otherwise agreed or notified in writing. For large orders, in the event of a change in creditworthiness, or following an individual assessment, different payment terms may apply, and full or partial prepayment may be required. We reserve the right to conduct a credit check through a credit insurer or other credit assessor. In the event of late payment, late payment interest will be charged in accordance with the Interest Act, as well as any reminder fees. The reminder fee amounts to 60 kronor. 

We reserve the right to change prices with immediate effect, for example in the event of changes in purchase prices, raw material costs, exchange rate fluctuations, transportation costs, government decisions, or other cost increases beyond our control. Price changes apply only to new quotes and orders. 

Reservation of Title and Repossession of the Purchased Item
The seller reserves the right of ownership of the goods from any of our companies. 

The term "item" refers to any product listed in our Amabilia Medical product catalogs. When an item from these product catalogs is ordered from our company, it is defined as an item. 

The Buyer is deemed to have fulfilled its obligations under the agreement once the goods have been paid for and ownership has been transferred. The Buyer is prohibited from selling, pledging, or otherwise disposing of the goods or any part thereof (for example, trading them in) before ownership has been fully transferred to the Buyer. 

Limitation of Liability

We are not liable for indirect damages, loss of production, loss of revenue, or other consequential damages that may arise from the use of our products or services. In all circumstances, our liability is limited to the amount corresponding to the value of the specific order. 

Confidentiality

We respect your privacy and handle all personal data in accordance with applicable laws and regulations. Your information is used solely to process your order and improve our service. We handle all data in accordance with the GDPR. Please see the following link to our GDPR policy.

Force Majeure

We shall not be liable for any failure to perform our obligations under this Agreement if such performance is prevented, impeded, or delayed as a result of circumstances beyond our reasonable control (force majeure). Such circumstances include, but are not limited to, natural disasters, war or acts of war, pandemics or epidemics, strikes or other labor disputes, government decisions, new or amended legislation, geopolitical events, blockades, fire, flooding, serious disruptions in transportation or data communications, and other unforeseen events that we could not reasonably have foreseen or avoided. If the force majeure event persists for more than two (2) months, we have the right to terminate the agreement in whole or in part in writing. 

Dispute Resolution

In the event of any disputes or disagreements arising in connection with these terms and conditions, the parties shall first attempt to resolve the dispute through negotiation. If a resolution cannot be reached, the dispute shall be settled in accordance with Swedish law in a Swedish court. 

Validity and Termination

These terms and conditions are valid until further notice and may be updated.
We will notify you of any updates on our websites and in our quotes. 

In the event of material changes to the terms and conditions, the customer must be notified at least 30 days before they take effect. Each order constitutes a separate agreement. 

The terms and conditions in effect at the time of ordering apply to each respective order. These general terms and conditions shall take precedence over the customer’s general terms and conditions, unless otherwise expressly agreed in writing. If the parties have entered into a separate agreement, that agreement shall take precedence over these general terms and conditions in the event of any conflict. By placing an order with us, you accept these terms and conditions in their entirety.
